Alternative Dispute Resolution (ADR) includes such processes and techniques as negotiated settlements, mediation, collaboration, and arbitration. ADR is gaining widespread acceptance among both clients and the legal profession. In fact, some courts now require parties to resort to ADR before permitting the parties’ cases to be tried. For example, on December 28, 2009, the Florida Supreme Court issued an administrative order that requires Mediation in all foreclosure cases on Homestead Properties before a default, summary judgment or a final hearing is held.
